  • Your acceptance of these Terms of Use (“TOU”)​

    By using engagementhub.com.au (“Software”), a product of My Business App Pty. Ltd. (ABN 99 069 154 829), you acknowledge and agree to these terms of use. Please ensure you have read and understood this information, prior to subscribing to our software.

    To the extent permitted by law, My Business App Pty. Ltd. and its partners exclude all liability in contract, tort (including negligence) or otherwise, arising from or in connection with the software. In regards to how we use and protect your information, please refer to our Privacy Policy.

    My Business App Pty. Ltd. reserves the right to update and change the 'Terms and Conditions' from time to time without notice. Any new features that augment or enhance the current software, including the release of new tools and resources, shall be subject to these 'Terms and Conditions'. Continued use of the software after any such changes shall constitute your consent to such changes.

    Account Terms

    • You must be 16 years or older to subscribe to our software
    • You must be a human. Accounts registered by “bots” or other automated methods are not permitted
    • You must provide your legal full name, a valid email address, and any other information requested to subscribe to our software.
    • You are responsible for maintaining the security of your account and password.  My Business App Pty. Ltd. cannot and will not be liable for any loss or damage from your failure to comply with this security obligation
    • You are responsible for all content posted and activity that occurs under your account (even when content is posted by others who have access to your account)
    • You may not use the Software for any illegal or unauthorised purpose. You must not, in the use of the Software, violate any laws in your jurisdiction (including but not limited to copyright laws)
    • Illegal and adult content is prohibited

    Payments and Refund Terms

    Clients may elect to have monthly, quarterly or annual billing. There are no refunds for partial months of service. In order to treat everyone equally, no exceptions will be made.

    All fees are inclusive of the Goods and Services Tax (GST) and are in Australian Dollars.

    Cancellation and Termination

    Accounts can be cancelled at anytime. You are solely responsible for properly cancelling your account. Account cancellation requests must be submitted in writing to accounts@mybusinessapp.com.au.  Cancellations by phone or sent to any other email address will not be considered valid.

    If you cancel the software before the end of your current paid up month, your cancellation will take effect immediately and you will not be charged again.

    My Business App Pty. Ltd., in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the Software, for breach of use or unpaid accounts.

    Modifications to the Service

    From time to time, My Business App Pty. Ltd. may issue an update to the Engagement Hub Platform which may add or modify features from the application. These updates may be pushed out automatically with little or no notice, although My Business App Pty. Ltd will do everything in its power to notify you in advance of an upcoming update, including details on what the update includes.

    Copyright and Content Ownership

    We claim no intellectual property rights over the material you use or post. Your content and users information remain yours completely. Furthermore, My Business App Pty. Ltd has no access to your registered users information. By using the Engagement Hub, you agree to allow others to view and share your published Content.

    My Business App Pty. Ltd. does not pre-screen content posted on clients' site, unless this service has been ordered by a client. Clients have the control to moderate content posted by their stakeholders.

    Engagement Hub is owned in its entirety by My Business App Pty. Ltd.. All rights reserved. You may not duplicate, copy, or reuse any portion of the intellectual property without express written permission from My Business App Pty. Ltd.

    Clients exclusively own all the response data and user information collected through their portal. Your user data is never used or shared by us. My Business App Pty. Ltd. Does not have access to your data, unless you provide one of our team members with a login and permission.

    General Conditions

    The Software is provided on an “as is” and “as available” basis.

    Technical support is available via our Helpdesk.

    You understand that My Business App Pty. Ltd. uses third party hosting partners to provide the necessary networking, storage, and related technology required to run the software.

    You must not modify, adapt or hack the Software or modify another website so as to falsely imply that it is associated with Engagement Hub, or any other My Business App Pty. Ltd. service.

    You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Software, use of the Software, or access to the Software without the express written permission by My Business App Pty. Ltd.

    We may, but have no obligation to, remove Content and Accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.

    You understand that the technical processing and transmission of the Software, including your Content, may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

    You must not upload, post, host, or transmit unsolicited email, SMSs, or “spam” messages.

    You must not transmit any worms or viruses or any code of a destructive nature.

    You expressly understand and agree that My Business App Pty. Ltd. shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if My Business App has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the software; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorised access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the software; (v) or any other matter relating to the software.

    The failure of My Business App Pty. Ltd. to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and My Business App Pty. Ltd. and govern your use of the software, superseding any prior agreements between you and My Business App Pty. Ltd. (including, but not limited to, any prior versions of the Terms of Service).
